APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

The present conditions regulate the use of the dalire.com service. Orders placed through the nezeni.com website imply full acceptance of the General Terms and Conditions, which are described below. These conditions are binding on both parties, the company and the consumer.

These conditions may be modified without prior notice, prevailing those published at the time of the use of the service. We strongly recommend reading them every time you access the website.

VALIDITY OF PRICES

The items for sale on the website are only available if they are visible on the website. In the event that the contract cannot be executed due to the unavailability of the purchased good, the consumer will be immediately informed of this circumstance and may request a refund of the sums paid at no cost to the consumer.

PRESENTATION OF THE PRODUCTS

The products offered for sale are described and presented as accurately as possible, subject to the limitations of current digital imaging technology.

PRICE OF PRODUCTS

All the prices of the products appear with VAT included. They do not include transport charges or payment type in case of being outside Peninsular Spain.

Nezeni Cosmetics reserves the right to modify its prices at any time. In the event of a price change, the products will be invoiced at the price in effect at the time the order was placed.

SECURE ORDERING AND PAYMENT

Nezeni Cosmetics offers the following payment methods:

Credit card

You can pay by credit card free of charge. Eventually we perform security checks for credit card payments. A photocopy of your ID may be requested along with the credit card as a measure to verify the cardholder’s ownership.

Payment using PayPal

Pay quickly and securely with your PayPal account or with your credit or debit card, without sharing financial information with Nezeni Cosmetics. PayPal automatically encrypts confidential data with the help of the best technologies available on the market. Orders paid using PayPal do not incur any surcharge on the total amount.

PayPal payment is only allowed in Europe and USA / Canada, all other countries only credit/debit card payment is accepted.

DEFAULT ON PAYMENT

Nezeni Cosmetics reserves the right to refuse to make a delivery or to process the order of a customer who has not paid in full or in part for a previous order or with whom there is an active payment dispute, as well as any order for which there is an indication of payment fraud.

Nezeni Cosmetics controls all orders registered on the site. These controls are intended to protect Nezeni Cosmetics against abusive fraudulent practices. Our Customer Service Department may request all documents necessary to process an order (proof of address or debit card in the customer’s name, proof of address of the person named on the delivery address, etc.). These requests will be made by e-mail or telephone:

In case of an order with a delivery address different from the one indicated as billing address.
In case of new customer.
In case of an order over 500 €.
In case of indications of credit card fraud.

PAYMENT SECURITY

To ensure payment security, Nezeni Cosmetics uses Banco Sabadell’s POS service. This service incorporates the SSL security standard so that confidential data (16-digit bank card number, expiration date, CSV code) are transmitted directly in encrypted form to the bank’s server, without registering on the Nezeni Cosmetics server.

In addition, if you choose to pay using PayPal, you can pay quickly and securely with your PayPal account or with your credit or debit card, without sharing financial information with Nezeni Cosmetics. PayPal automatically encrypts sensitive data with the help of the best technologies available on the market.

IDENTIFICATION

The customer who has already made a purchase at Nezeni Cosmetics can choose a password that allows him/her to avoid having to fill in the previous order forms for future purchases.

Nezeni Cosmetics recognizes customers who are already registered as its own customers. The password assigned to the customer is strictly confidential and personal and must not be disclosed or communicated to anyone.

In case the Nezeni Cosmetics customer forgets or loses his or her password, he or she must use the corresponding link when accessing the website.

To facilitate the identification of the customer, the customer simultaneously provides a password and e-mail address, expressly authorizing Nezeni Cosmetics to register in its system a file called “cookie” whose sole purpose is to facilitate such identification.

RETURNS OF DEFECTIVE PRODUCTS OR PRODUCTS IN BAD CONDITION. LEGAL GUARANTEE.

Warranty. Return of non-conforming products

Despite our strict quality controls, for reasons beyond our control, you may receive an item with a manufacturing defect or in poor condition. Nezeni Cosmetics is responsible for this under the terms established in the consumer protection legislation.

According to this regulation, products are guaranteed for two years from the date of delivery. The consumer must report the lack of conformity within two months of becoming aware of it.

As soon as you notice that the product is not in conformity, please contact our customer service, e-mail: [email protected] communicating the incident.

Nezeni Cosmetics is not liable for negligent or improper use of the purchased product.

In case of defective product or in bad condition, we will proceed to its replacement. Our carrier will pick up the defective product. It is essential that you enclose a copy of the sales invoice.

Once the conditions for the replacement of the product have been verified, a new one will be sent to you without further delay. All the steps will be completely free of charge for the consumer.

RIGHT OF WITHDRAWAL. EXCHANGE OR REFUND PROCEDURE

Nezeni Cosmetics offers its customers the possibility to return their orders, except for the cost of shipping and return of the package.

However, due to health protection and hygiene reasons, we do not accept the return of products unsealed from the security shipping bag, except for products in poor condition.

In order to exercise your right of withdrawal, the consumer must inform Nezeni Cosmetics by email to [email protected]. To do this, you can use, but is not mandatory, the form available through the following link: withdrawal documentwhich is in accordance with the model attached to the Law on the defense of the rights of consumers and users (RDLeg. 1/2007 of 16 November).

Conditions for exchanges or returns

The customer has a period of 14 calendar days to request an exchange for another item or exercise his right of withdrawal, counting from the date of receipt of the item(s). It is not necessary to indicate a reason for exercising the right of withdrawal. For a more agile processing, we appreciate that the customer follows the procedure detailed below, although it is not mandatory for the exercise of the rights referred to in this section.

Step 1: Contact via email [email protected] to communicate that you wish to return your order. You will be able to use and send the withdrawal document model mentioned above. We will immediately send you confirmation of receipt of your request.
Step 2: Return your order under the same conditions as you received it. Nezeni Cosmetics will send a courier to your home to pick up your order.
You will be responsible for the direct cost of returning the goods and the cost of shipping.
Step 3: Upon receipt of the items, Nezeni Cosmetics will refund the total amount paid by you minus the cost of return and shipping: cost of collection and management of reinstatement to the warehouse. Nezeni Cosmetics reserves the right of compensation for items sent to the customer and returned by the customer in the following cases:

When the products have been used or handled in an improper or negligent manner or not in accordance with their characteristics by the Customer.
When the products have been damaged or deteriorated.
When the return by the customer is not made in its box.
When the lack of conformity is due to wear and tear from normal use.
If any of the information on the receipt or proof of purchase is modified, altered or substituted.
If the serial or product identification number is tampered with.
If all items, accessories, cases or boxes are not returned with the product.

RESPONSIBILITY

In all phases of accessing the site, consultations, filling out forms, placing orders, delivery of items or any other service, Nezeni Cosmetics assumes no responsibility in case of damage or impairment resulting from the use of the Internet network.

Nezeni Cosmetics will not assume any responsibility in case of anomaly in the supply of the service, external intrusions or computer virus. In the same way, Nezeni Cosmetics is not responsible in case of unforeseen circumstances or force majeure.

CONDITIONS OF USE OF CONTENTS AND INTELLECTUAL PROPERTY PROTECTION

The user undertakes to use the services and contents of the website correctly, diligently and lawfully. Its use for purposes contrary to law, morality, good customs or public order is prohibited.

The content of this website is the property of Nezeni Cosmetics. The legislation on Intellectual Property confers the exclusive right to such content. Therefore, Nezeni Cosmetics prohibits its partial or total use by third parties, unless otherwise agreed in writing. Consequently, the total or partial reproduction, by any physical or electronic means, of the content of this website is expressly prohibited.

Nezeni Cosmetics will take all appropriate legal measures to prevent unauthorized use of the content of the nezeni.com website.

PRODUCT REVIEWS AND RATINGS

All comments must comply with the rules of participation below and always respect other users. Otherwise, Nezeni Cosmetics reserves the right to refuse the publication of such comments.

Comments whose content or links may be considered defamatory, abusive, insulting, libelous or contrary to Spanish law, including those that constitute advocacy of terrorism or violence in general, or those that may involve any violation of the rights of minors and children will not be accepted.
Comments with racist, sexist, homophobic, discriminatory content based on gender identity or that, in general, may be interpreted as an attack on any group or minority based on aspects such as nationality, sex, religion, age or any type of physical or mental disability will not be admitted.
Comments may not include threats, insults, or personal attacks on other participants in the discussion forum.
Comments that contain spam, commercial advertising or specially copyrighted material will not be accepted.
Comments whose sole purpose is to manifestly sabotage the discussion (e.g., the same paragraph, link, sentence, etc. repeated 25 times) will be deleted.

Nezeni Cosmetics reserves the right to make unannounced changes it deems appropriate in its website, may change, delete or add content and services provided through the same as the way in which they are presented or located on its website.

The relationship between Nezeni Cosmetics and the user shall be governed by the Spanish legislation in force.
